How Contract Assignments Work for Cash Buyers

When you buy a deal from our buyers list, you're usually purchasing our equitable interest in a purchase contract, not the property itself. You step into our position and close directly with the seller.

What to expect

  • Written disclosure. Texas law requires us to tell you in writing that we hold a contract interest, not legal title.
  • An assignment fee. This is the difference between our contract price and your purchase price, and it's stated up front.
  • A title company closing. Earnest money and the assignment fee are handled at closing.

How to move fast

  1. Know your buy box: price range, areas, and the rehab budget you're comfortable with.
  2. Have proof of funds ready.
  3. Run your own numbers and walk the property. We share what we know, but you decide.

Texas Disclosures

We are not a licensed real estate broker.

Monterey Property Solutions may enter into a purchase contract and assign its equitable interest in that contract to a third-party buyer for a fee, or may purchase, renovate, and resell the property itself.

In accordance with Texas Occupations Code ยง1101.0045, we provide written disclosure to sellers that we may assign the contract rather than close on the purchase, and to buyers that we are selling only an equitable interest in a contract and do not hold legal title to the property.
